National Class Action Lawsuit Settled

In November 2010, Girard Gibbs LLP filed a national class action lawsuit alleging that the plastic fuel tanks on certain Ducati motorcycles are defective because they degrade and deform due to an incompatibility with the motorcycles’ fuel. On January 12, 2012, the Court fully approved a settlement that provides an extended warranty and repairs for fuel tank expansion issues, including cosmetic imperfections.

Do I have an extended warranty under the settlement?

U.S. residents who on September 16, 2011 owned any 2003-2011 Ducati Monster, Multistrada, SportClassic, Streetfighter, Superbike or Hypermotard motorcycle manufactured with a plastic fuel tank received the extended warranty when the Court approved the settlement. Ducati will also honor the extended warranty for people who acquire one of these motorcycles after September 16, 2011, if the new owner accepts the terms of the settlement.

However, people who asked to be excluded from the settlement class and employees of Ducati or Girard Gibbs did not receive the extended warranty under the settlement.

What does the extended warranty cover?

For expansion problems that are not purely cosmetic, the extended warranty will cover repairs for the longer of 6 years from the original sale date or until 18 months after February 14, 2012, whichever provides longer coverage for a particular motorcycle. For purely cosmetic expansion problems, the extended warranty will cover repairs for the longer of 5 years from the original sale date or until 18 months after February 14, 2012.

How do I receive repairs under the extended warranty?

To receive repairs under the settlement, you must take your motorcycle to an authorized Ducati dealer.
