Best Buy / MSN Class Action Lawsuit
LAWSUIT AGAINST MICROSOFT AND BEST BUY UNDERWAY
On October 14, 2004, Girard Gibbs filed a class action lawsuit in the Superior Court of the State of Washington on behalf of all Best Buy customers who were signed up for trial subscriptions to Microsoft's MSN internet service, never logged onto or used MSN, but were charged regular monthly fees by Microsoft after the trial period ended.
On April 10, 2006, the Court certified a nationwide class of consumers who paid Microsoft in connection with MSN internet account established in their names at Best Buy stores but who did not log onto the accounts. The Court found that this lawsuit implicates unfair conduct “that encompassed Defendants’ decision to structure their MSN trial promotion in such a way as to require individuals who never logged on to or otherwise used the service to call to terminate the trial subscriptions or be charged by Microsoft.”
