Women filing federal Yaz Side Effects Lawsuits will have cases automatically transferred to Multidistrict Litigation

Hundreds of women suffering from serious side effects after taking the birth control pills Yaz, Yasmin and Ocella have filed Yasmin lawsuits. Recently these federal lawsuits were coordinated before a single federal court and judge in Illinois. The coordination procedure is known as Multi-District Litigation (MDL). The purpose of an MDL is to promote efficiency and economy by transferring all pending federal cases throughout the country that deal with a similar issue (such as injuries relating to the use Yaz and Yasmin birth control) to one judge. The Yaz Multi-District Litigation lawsuits are not class action lawsuits rather they are part of a mass tort, meaning that each individual is able to bring their own claim rather than having one person who sues on behalf of all women making claims.

Chief U.S. District Judge David R. Herndon, of the United States District Court of the Southern District of Illinois, is overseeing the Yaz and Yasmin MDL, which has been entitled In re: Yasmin and Yaz (Drospirenone) Marketing, Sales Practices and Products Liability Litigation (master docket number 09-2100). Due to this recent case coordination, any federal lawsuit that is filed going forward involving a Yaz injury will likely be brought underneath the umbrella of this MDL along with hundreds of other similar cases. This means that if you file a federal lawsuit concerning injuries allegedly related to Yaz, Yasmin or Ocella, your lawsuit will also likely be transferred to the Yaz MDL. Additionally, pursuant to a recent Case Management Order (CMO) entered by the Court to promote efficiency and economy, any new plaintiffs can file their individual cases directly in the MDL proceeding, instead of having to file in their home state and wait for a transfer to the MDL.

California Yaz Lawyer Appointed to Multi-District Litigation Plaintiffs’ Steering Committee

In the MDL, Judge Herndon has appointed a Plaintiffs’ Steering Committee, which will be responsible for conducting and coordinating pretrial proceedings in the litigation. In an order issued by the Court on November 10, 2009, Judge Herndon appointed Yaz Lawyer A. J. De Bartolomeo to the Plaintiffs’ Steering Committee. Along with the other committee members, Ms. De Bartolomeo will serve as a spokesperson for all plaintiffs at pretrial proceedings and in response to any inquiries by the Court.
