BMW Class Action Lawsuit
PROPOSED CLASS SETTLEMENT FOR BMW 5-SERIES AUTOMOBILE OWNERS AND LESSEES
Girard Gibbs filed this class action lawsuit against BMW of North America in December 2004 in the Los Angeles County Superior Court. The lawsuit alleges that the “seat occupation detection system” in some 2004-2005 BMW 5-Series automobiles is defective, in that it deactivates the front-passenger airbags even when the front passenger seat is occupied by an adult who exceeds the minimum weight activation threshold. The system is intended to deactivate only when the front passenger seat is occupied by a child whose weight does not exceed a certain threshold. The parties have reached a settlement of the lawsuit that requires BMW to, among other things, reprogram the airbags in the front-passenger seats to correct the defect at issue in the case. On May 22, 2007, the Court granted preliminary approval of the proposed class settlement.
