Hyundai Tiburon Defective Clutch Lawsuit
CLUTCH IN 2003 HYUNDAI TIBURON FOUND TO FAIL PREMATURELY
On April 27, 2006, Girard Gibbs filed a class action complaint in the United States District Court for the Central District of California alleging that the factory-installed flywheel and clutch in the 2003 Hyundai Tiburon prematurely fails. The complaint also alleges that Hyundai is aware of the defective nature of the flywheel system and yet as a practice and policy, refuses to replace it under warranty and blames the failure on customer misuse.
A total of five cases were filed throughout the country. The Honorable Alicemarie Stotler of the Central District consolidated these cases into a single nationwide case and appointed Girard Gibbs LLP and Stueve Siegel Hanson Woody LLP interim class counsel. We filed an amended consolidated complaint and continue to conduct discovery.
On February 20, 2007, Girard Gibbs filed a motion for an order certifying the class. This motion, if granted, would allow this case to proceed on behalf of everyone who meets the class definition described above.
