2003 Hyundai Tiburon GT Class Action Settlement
Girard Gibbs LLP filed a class action complaint in federal court in 2006 involving the 2003 Hyundai Tiburon. The complaint alleged that though Hyundai knew the vehicles’ flywheel and clutch parts failed prematurely, it sold the vehicles without telling customers and later refused to cover repairs under warranty.
On June 28, 2010, Judge Alicemarie H. Stotler approved a nationwide settlement that provided cash reimbursements to eligible Class Members. More information about the settlement can be found in the Notice of Class Action Settlement and below.
Hyundai Class Action Suit: What are the Settlement Benefits?
Eligible Class Members can receive cash reimbursements for money spent on certain repairs to flywheel / clutch parts on their 2003 Hyundai Tiburons. The reimbursement amount will be based on the amount spent and the mileage at the time of the repair:
For vehicles with up to 50,000 miles at the time of repair, the reimbursement is typically 100% of the amount paid for the repair.
For vehicles with between 50,001 and 75,000 miles at the time of repair, the reimbursement is typically 75% of the amount paid for the repair.
For vehicles with between 75,001 and 100,000 miles at the time of repair, the reimbursement is typically 50% of the amount paid for the repair.
Class members can also receive up to $150 in related rental expense reimbursements.
Hyundai Tiburon Class Action: Who are the “Class Members”?
Class Members are “all current and former owners and lessees of a manual-transmission 2003 Tiburon GT, produced on or before April 1, 2003, who paid for a replacement to the flywheel assembly, clutch disk assembly, clutch cover assembly, or clutch release bearing within the applicable warranty period.”
Hyundai Class Action Lawsuit: Who Can Claim Reimbursements?
The deadline to submit a claim for most past repairs has passed. However, you can still timely file a claim for reimbursement if you are a Class Member and:
You are the original owner of a manual-transmission 2003 Tiburon GT, produced on or before April 1, 2003;
You were denied warranty coverage and paid for a repair to the flywheel assembly, clutch disc assembly, clutch cover assembly, or clutch release bearing within the past 60 days or in the future; and
Your vehicle was still within warranty at the time of the repair, meaning it was within both 10 years and 100,000 miles of when the car was first sold or leased.

If you meet the three criteria above, file a claim postmarked within 60 days of the denial of warranty coverage by:
Printing and completing a Settlement Claim Form.
Making a copy of both the completed and your repair receipt.
