Intel Class Action Lawsuit
MISREPRESENTATION OF PENTIUM 4 MICROPROCESSORS
In March 2004, Girard Gibbs filed a class action lawsuit in the Superior Court of the State of California against Intel Corporation and Hewlett-Packard Company on behalf of a nationwide class of consumers who purchased or leased a Pentium 4 microprocessor or a computer containing a Pentium 4 microprocessor with clock speeds ranging from 1.3 to 1.8 gigahertz.
This lawsuit alleges that Intel released the Pentium 4 prematurely, and that Intel and HP marketed the Pentium 4 to create the impression that the Pentium 4 outperformed the latest Pentium III, when they knew it did not. The lawsuit further alleges that Intel and HP exploited consumers’ reasonable expectation that the Pentium 4 would outperform the cheaper Pentium III by charging premium prices for the Pentium 4.
We are currently gathering evidence from consumers and from Intel for the purpose of filing a motion for an order certifying the class. This motion, if granted, would allow this case to proceed on behalf of everyone who meets the class definition described above.
