Mitsubishi Eclipse Class Action Lawsuit
Settlement Reached in Mitsubishi Eclipse Class Action Lawsuit.
Girard Gibbs filed a class action lawsuit on behalf of consumers who purchased or leased a 1997-2002 model year Mitsubishi Eclipse with 17 inch rims, alleging that Mitsubishi concealed the defective nature of these rims from consumers. According to the lawsuit, the rims bend when subjected to normal wear and tear, resulting in lower tire pressure. The lawsuit further alleged that the defective rims posed a safety threat to the general public, as drivers have lost control of their vehicles when the defective rims caused their tires to blow out.
The lawsuit contended that Mitsubishi failed to adequately test the rims before putting them on the market, continued to advertise and sell vehicles containing the defective rims to consumers after becoming aware of the problem, and failed to replace the defective product.
Class Action lawsuits were filed in Missouri, Kansas and California state and federal courts. On October 4, 2005, Jackson County Circuit Judge Marco Roldan approved a $33 million nationwide class settlement, providing cash reimbursement for class members.
