An employer who requires or permits an employee to work overtime is generally required to pay the employee premium overtime pay for such work.

Overtime Pay Laws

Federal Overtime Pay Law - In the United States, federal labor law (FLSA) establishes a standard workweek of 40 hours for most employees and requires that these workers are paid at least one and one-half times their normal rate of pay for overtime work hours. Certain overtime exemptions apply depending on whether a worker is an exempt employee.

State Overtime Law - Many states have their own overtime laws. In cases where an employee is subject to both the state and federal overtime laws, the employee is generally entitled to the overtime standard that will provide the higher overtime pay. (Learn more about California Overtime Pay Law.)
