About the Telephone Consumer Protection Act (TCPA)
Girard Gibbs represents consumers in class action lawsuits for violations of the Telephone Consumer Protection Act (TCPA). The TCPA was passed in response to consumer complaints about the growing number of unsolicited telemarketing calls and the increasing use of autodialers and robo-callers. Under the TCPA, consumers have the right to sue for violations of the law involving the "do not call list," autodialers, faxes, calls to cellular phones, and artificial or prerecorded messages.
Telephone Consumer Protection Act (TCPA) Violations
Telephone marketing calls & "Do-Not-Call" lists
The TCPA prohibits solicitation calls before 8 am or after 9 pm local time and requires telemarketers to comply with any do-not-call request you make directly to the caller during a solicitation call.
Autodialers & Robocalls under the TCPA
The Federal Communications Commission (FCC) has specific rules for automatic telephone dialing systems, also known as "autodialers" or "robo-callers." Unless the person being called has given prior express consent, the TCPA and FCC rules under the TCPA generally require that:
-
telemarketing calls cannot be made to residences with artificial voices or recordings
-
calls cannot be made with artificial voices or recordings to cell phones or to any service the recipient is charged for the call
-
unsolicited advertising faxes are prohibited
