Unauthorized Charges Class Action Lawsuits

These unauthorized charges can occur when a company releases consumers’ private financial data to a third party, or when a company charges consumers for services they did not request.
The Electronic Funds Transfer Act requires that a company obtain written authorization from a consumer before making a preauthorized electronic transfer (a regularly scheduled transfer authorized in advance) from the consumer’s account. Unfortunately, many companies fail to comply with this requirement of the EFTA.
UNAUTHORIZED CHARGES CLASS ACTION LAWSUITS
Trilegiant Class Action Lawsuit
On July 18, 2008, the Illinois Circuit Court granted final approval to the class action settlement reached with Trilegiant Corporation. This settlement affected people who had unsolicited or unauthorized charges assessed to their credit card, debit card, phone, bank, mortgage or other billing accounts by Trilegiant.

Providian Class Action Lawsuit
Girard Gibbs achieved the largest all-cash settlement for a class action lawsuit brought on behalf of victims of fraudulent credit card practices, including unauthorized charges, in its case against Providian Financial. The case alleged that Providian had charged credit card customers for fee-based programs, including discount programs and a credit protection plan, without their authorization.

Certegy Class Action Lawsuit
On August 14, 2007, Girard Gibbs filed a class action complaint against Certegy Check Services on behalf of consumers whose personal and financial data was sold to third-parties by a Certegy employee. The complaint alleged that Certegy, a company that provides check verification services to major U.S. retailers, failed to implement sufficient security measures to protect customers’ personal information.
