Verizon Wireless Instant Messenger Lawsuit
Suit Alleges Unauthorized Charges for Instant Messaging
Girard Gibbs has filed a class action lawsuit in federal court in New Jersey against Verizon Wireless relating to its customers’ use of “instant messaging” on the Verizon Wireless cellular network. The complaint alleges that Verizon Wireless, while representing that customers who use instant messaging will be charged only for messages sent or received, in fact, the company imposes charges simply as a result of logging in, regardless of whether the user sends or receives any instant messages. The lawsuit further alleges that when customers complain about these charges, Verizon Wireless attempts to “upsell” customers to more expensive monthly packages and thus profits further from these improper charges.
